These Distance Selling Terms apply to purchases made directly through the SPARXLY online store operated by SPARKLEXTOOLS LTD.

Please read these terms carefully before placing an order. They explain how a contract is formed between you and us, how orders and deliveries are handled, and your rights when purchasing products online.

Nothing in these terms excludes, restricts or otherwise affects your statutory rights under applicable United Kingdom consumer law.

2. SCOPE OF THESE TERMS

These terms apply to consumer purchases made directly through our SPARXLY online store.

Our online store currently serves customers at eligible delivery addresses within the United Kingdom.

Where SPARXLY products are purchased through a third-party marketplace such as Amazon, the marketplace's applicable terms and policies may also apply to that transaction.

These Distance Selling Terms apply specifically to orders placed directly with SPARKLEXTOOLS LTD through our own online store.

3. PRODUCTS

We take reasonable care to ensure that product descriptions, specifications, photographs, prices and other information displayed on our website are accurate.

Product images are provided to help illustrate the product. Colours and appearance may vary slightly depending on your screen, device or display settings.

Minor variations that do not materially affect the functionality or characteristics of a product may occur.

Nothing in this section affects your statutory rights if goods are faulty, not as described, not fit for purpose or otherwise fail to meet applicable legal requirements.

4. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your shopping basket does not reserve that product.

If a product becomes unavailable after you submit an order, we will notify you as soon as reasonably possible.

If we cannot supply an item for which payment has already been taken, we will refund the relevant amount using the original payment method unless otherwise agreed with you.

5. PLACING AN ORDER

To place an order through our website, you will be required to:

  1. Select the product and, where applicable, the required variant.
  2. Add the product to your shopping basket.
  3. Review your order.
  4. Provide your contact, billing and delivery information.
  5. Select an available delivery method.
  6. Select an available payment method.
  7. Review the total price and applicable delivery charges.
  8. Submit your order and payment.

Before submitting your order, you should check that the information provided is complete and accurate.

By submitting an order, you are making an offer to purchase the selected products from SPARKLEXTOOLS LTD subject to these terms.

6. ORDER ACKNOWLEDGEMENT AND CONTRACT FORMATION

After you place an order, we will normally send you an electronic acknowledgement confirming that we have received it.

An order acknowledgement does not necessarily mean that your order has been accepted.

A legally binding contract between you and SPARKLEXTOOLS LTD is formed when we confirm acceptance of your order or send you confirmation that the order has been dispatched.

We reserve the right to decline an order before acceptance where reasonably necessary, including where:

  • The product is unavailable
  • Payment cannot be authorised
  • The delivery address cannot be serviced
  • We reasonably suspect fraudulent or unauthorised activity
  • There is an obvious pricing or product information error
  • Accepting the order would breach applicable law

If we decline an order after receiving payment, the appropriate amount will be refunded.

7. PRICES

All prices displayed through our online store are stated in Pounds Sterling (GBP) unless otherwise indicated.

The total amount payable will be displayed before you submit your order.

This will include applicable product charges, taxes where required and any delivery charges that apply to your order.

We may change product prices from time to time.

Price changes will not affect an order that has already been accepted by us.

8. PRICING ERRORS

We make reasonable efforts to ensure that prices displayed on our website are correct.

However, obvious pricing or technical errors may occasionally occur.

If we discover an obvious error before accepting your order, we may contact you and provide the opportunity to purchase the product at the correct price or cancel the order.

If payment has already been taken for an order that we cannot accept because of an obvious error, the applicable amount will be refunded.

9. PAYMENT

Available payment methods will be displayed during checkout.

Payment must be made using one of the payment methods available through our checkout.

Payments may be processed by third-party payment service providers.

You confirm that you are authorised to use the payment method submitted with your order.

Payment information is handled in accordance with our Privacy Policy and the applicable policies of our payment service providers.

10. DELIVERY

We currently deliver to eligible addresses within the United Kingdom.

Available delivery services, estimated delivery times and applicable charges will be displayed during checkout or explained in our Shipping Policy.

Our standard estimated delivery time is generally:

2–3 business days

unless a different delivery estimate is displayed for your order.

Business days generally mean Monday to Friday, excluding UK bank holidays.

Delivery estimates may occasionally be affected by circumstances outside our reasonable control.

Unless a different delivery period has been agreed with you, we will comply with applicable UK legal requirements concerning the time within which goods must be delivered.

For detailed delivery information, please refer to our Shipping Policy.

11. DELIVERY ADDRESS

You are responsible for providing a complete and accurate delivery address.

Please check your delivery information carefully before submitting an order.

If you notice an error after placing your order, contact us as soon as possible at:

info@sparklex.net

We will make reasonable efforts to correct the address before dispatch, but we cannot guarantee that changes will be possible once fulfilment or delivery has begun.

12. RISK DURING DELIVERY

Where we arrange delivery, the goods remain at our risk until they are delivered into your physical possession or the physical possession of a person identified by you to receive them, subject to applicable law.

If a parcel is lost or damaged while being transported by a delivery service arranged by us, please contact us.

We will investigate the matter and provide an appropriate remedy where required.

13. YOUR RIGHT TO CANCEL

If you are a consumer purchasing eligible goods online, you generally have the legal right to change your mind and cancel your purchase without giving a reason.

For most eligible goods, you may notify us that you wish to cancel within 14 days after the day on which you, or a person nominated by you, receives the goods.

If an order contains multiple goods delivered separately, the applicable cancellation period may run from receipt of the last applicable item where required by law.

To exercise your cancellation right, you must clearly inform us of your decision to cancel.

You can contact us at:

Email: info@sparklex.net

You may use the Model Cancellation Form provided at the end of these terms, but you are not required to use that form.

14. RETURNING GOODS AFTER CANCELLATION

After notifying us that you are cancelling an eligible purchase, you must return or send the goods back without undue delay and, in any event, within 14 days after informing us of your decision to cancel, unless otherwise agreed.

Please contact us before sending a return so that we can provide the appropriate return instructions and return address.

Do not send products to our registered office unless we specifically instruct you to do so.

The registered office of SPARKLEXTOOLS LTD may not be the location at which customer returns are processed.

15. RETURN COSTS FOR CHANGE-OF-MIND RETURNS

Unless we state otherwise, if you exercise your statutory cancellation right simply because you have changed your mind, you will normally be responsible for the direct cost of returning the goods to us.

Any applicable return arrangements will be explained when your return is authorised.

This does not apply where the goods are faulty, damaged, misdescribed or otherwise do not conform to the contract and applicable law requires us to bear the relevant return costs.

16. CONDITION OF RETURNED GOODS

You may inspect goods in a way reasonably necessary to establish their nature, characteristics and functionality.

You should take reasonable care of products while they are in your possession.

Where permitted by law, we may reduce the amount refunded to reflect any reduction in the value of goods caused by handling beyond what is reasonably necessary to establish their nature, characteristics and functionality.

This does not affect your statutory rights in relation to faulty or non-conforming goods.

17. EXCEPTIONS TO THE RIGHT TO CANCEL

The statutory right to cancel may not apply to certain categories of products where an exception under applicable law applies.

Depending on the product, these may include certain:

  • Goods made to your specifications or clearly personalised
  • Goods that are liable to deteriorate or expire rapidly
  • Sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed
  • Sealed audio, video or software products once unsealed
  • Goods that become inseparably mixed with other items after delivery
  • Other products or circumstances excluded from the statutory cancellation right by law

Where a cancellation exception applies to a particular product, we will provide relevant information where required.

These exceptions do not remove any statutory rights you may have where goods are faulty, damaged, unsafe, misdescribed or otherwise fail to conform to the contract.

18. REFUNDS AFTER CANCELLATION

Where you validly cancel an eligible order, we will refund payments due to you in accordance with applicable UK law.

For returned goods, we may wait until:

  • We receive the goods back; or
  • You provide evidence that you have sent the goods back,

whichever occurs first, where permitted by law.

The refund will normally be made within 14 days of the relevant date required by law.

Refunds will generally be made using the same payment method used for the original transaction unless you expressly agree otherwise.

We will not charge you a fee solely for processing the statutory refund.

19. ORIGINAL DELIVERY CHARGES

Where you cancel an entire eligible order under your statutory cancellation rights, we will refund the standard outbound delivery charge where required by law.

If you selected a more expensive delivery option than the least expensive standard delivery method offered by us, we are not required to refund the additional amount attributable to the upgraded delivery method.

Where only part of an order is returned, the treatment of delivery charges will depend on the circumstances and applicable law.

20. FAULTY, DAMAGED OR MISDESCRIBED GOODS

Your change-of-mind cancellation rights are separate from your legal rights where a product is faulty or otherwise does not conform to the contract.

Under applicable UK consumer law, goods supplied to consumers must meet legal requirements, including being:

  • Of satisfactory quality
  • Fit for their intended purpose
  • As described

If a product is faulty, damaged, misdescribed or otherwise fails to meet applicable legal requirements, you may be entitled to remedies including a refund, repair or replacement depending on the circumstances.

UK consumer law may provide a 30-day short-term right to reject qualifying faulty goods, subject to the applicable legal conditions.

Nothing in these terms or any other SPARXLY policy limits or replaces your statutory rights.

Please contact:

info@sparklex.net

and include your order number and details of the problem.

Photographs of the product and packaging may help us investigate damage or other issues more quickly, but requesting supporting information will not be used to unlawfully restrict your statutory rights.

21. LOST OR DAMAGED PARCELS

If your order does not arrive or arrives visibly damaged, please contact us as soon as reasonably possible.

Where we arranged the delivery, we will investigate the issue with the delivery carrier.

We may arrange a replacement, refund or another appropriate remedy depending on the circumstances and your legal rights.

You will not be required to resolve a claim directly with our delivery carrier where responsibility for delivery remains with us under applicable law.

22. ORDER CANCELLATION BEFORE DISPATCH

If you wish to cancel an order before it has been dispatched, please contact:

info@sparklex.net

as soon as possible.

Where operationally possible, we will attempt to stop the order before dispatch.

If dispatch has already occurred, your cancellation and return will be handled in accordance with your applicable statutory rights and our Refund Policy.

23. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional terms displayed with the relevant promotion.

Unless otherwise stated:

  • Promotions are valid for the specified period only
  • Discount codes may be limited to qualifying products or orders
  • A promotion may not be combined with another offer
  • Promotional codes have no cash value

Nothing in a promotion will reduce your statutory consumer rights.

24. OUR RESPONSIBILITY TO YOU

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these terms limits or excludes liability for matters that cannot legally be excluded, including liability arising from:

  • Death or personal injury caused by negligence where applicable
  • Fraud or fraudulent misrepresentation
  • Faulty or misdescribed goods where statutory liability applies
  • Breach of statutory consumer rights
  • Any other liability that cannot lawfully be excluded or restricted

We are responsible for losses that are a foreseeable consequence of our breach of the contract or failure to use reasonable care where required by law.

Nothing in this section affects your statutory rights.

25. EVENTS OUTSIDE OUR REASONABLE CONTROL

Occasionally, an order may be affected by circumstances outside our reasonable control, such as severe weather, significant transport disruption, major courier disruption or other comparable events.

Where this occurs, we will take reasonable steps to minimise the effect on your order and communicate material delays where appropriate.

This provision does not remove any statutory remedies you may have where goods are not delivered within the legally applicable or agreed period.

26. PERSONAL INFORMATION

Personal information collected when you place an order will be handled in accordance with our Privacy Policy.

Our Privacy Policy explains how SPARKLEXTOOLS LTD collects, uses, stores and shares personal information and describes your applicable data protection rights.

27. COMPLAINTS

If you are dissatisfied with a product, order or service, please contact us so that we can investigate the matter.

Email: info@sparklex.net
Phone: +44 7454 752531

Please provide your order number and sufficient information to help us understand the issue.

We will make reasonable efforts to resolve complaints fairly and promptly.

28. GOVERNING LAW AND CONSUMER RIGHTS

These terms and purchases made directly through our online store are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply to you.

If you are a consumer resident elsewhere within the United Kingdom, nothing in these terms deprives you of mandatory consumer protections or any rights you may have to bring proceedings in a court available to you under applicable law.

29. RELATIONSHIP WITH OUR OTHER POLICIES

These Distance Selling Terms should be read together with our:

  • Terms of Service
  • Refund Policy
  • Shipping Policy
  • Privacy Policy
  • Legal Notice

If there is any inconsistency, nothing in any SPARXLY policy will be interpreted in a way that unlawfully limits your statutory consumer rights.
